If you purchased, used or had DevaCurl products used on you in the timeframe indicated, then you may be entitled to part of the DevaCurl Hair Loss Settlement. Because, DevaCurl is accused of allegedly making haircare products which allegedly caused scalp irritation, hair loss, and balding. This lawsuit is known as In Re: Deva Concepts Products Liability Litigation, No: 1:20-cv-01234-GHW, in the United States District Court for the Southern District of New York.

What’s this settlement about?
A lawsuit is pending claiming that Deva Concepts, LLC (the “Defendant”) designed, manufactured and sold DevaCurl Haircare Products (“DevaCurl” or the “Products”) which allegedly caused certain users to suffer personal injury including hair loss, hair damage or scalp irritation and also claiming that statements made in connection with the marketing of the Products were false and misleading (the “Lawsuit”). Defendant vigorously denies these allegations and contends that there is no link between hair damage and DevaCurl, and that Defendant did not make any untrue or misleading statements.

Who is eligible for a refund?
You are included if between February 8, 2008 and August 29, 2021 you purchased, used, or had used on you at least one DevaCurl cleanser, conditioner, styling or treatment product.
Is a receipt required?
Proof of purchase is not required. However, if you have receipts, you may be able to claim more.
How much will I get back?
Tier 1
- one-time cash payment of up to $20
- No proof of purchase necessary
- $750,000 of the Fund allocated to Tier 1. If Tier 1 Claims exceed the $750,000 allocated to pay Tier 1 Claims, the payments made to each Class Member who submit a valid Tier 1 Claim will be reduced on a pro rata basis.
Tier 2
- up to $19,000 per Class Member, and up to $1,000 for provable expenses to compensate Class Members for claimed adverse reactions causing personal injuries such as hair loss, hair damage, scalp irritation and emotional distress that accompanied such alleged injuries and any claims of misleading marketing.
- Class Member must submit a valid and complete Claim Form, along with Supporting Documentation as described therein.
- As with any personal injury settlement, if you visited a medical professional, an insurance carrier that paid for any portion of your medical bill is entitled to a portion of your settlement.
- The remainder of the Fund, after payment of costs of notice and administration, Service Awards, Attorneys’ Fees and Costs and Tier 1 Claims, will be used to pay Tier 2.

What is a class action lawsuit settlement?
For example, a class action lawsuit is one with multiple plaintiffs. In other words, there are more than one person being represented by the lawsuit. In other words, a plaintiff or plaintiffs file the case on behalf of many people who were affected by aren’t involved in the actual suit. For example, if you purchased an item that was later determined to be involved in a class action lawsuit, you may be entitled to compensation. If you’re included in the class or group of people affected, then you can file a claim to receive money, coupons or replacement products.
