EpiPen Class Action Settlement, Claim with No Receipts!
If you purchased an EpiPen, EpiPen Jr and/or their epinephrine injection, USP authorized generics in the timeframe indicated, then you may be entitled to part of the $345 million settlement. Because, a settlement of $345,000,000 has been reached between the Class Plaintiffs and the Pfizer Defendants (which are Pfizer, Inc., Meridian Medical Technologies, Inc., and King Pharmaceuticals LLC (f/k/a King Pharmaceuticals, Inc.)). This Settlement does not concern the resolution of the claims against other defendants in the Action, specifically Mylan N.V., Mylan Specialty L.P., Mylan Pharmaceuticals Inc., Viatris Inc., or Heather Bresch (collectively, the “Mylan Defendants”). Those claims remain pending in the Court and trial of those claims is currently scheduled to commence on January 24, 2022.

What’s this settlement about?
Did Pfizer commit price fixing, and cause patients to overpay for EpiPens? The court has not decided whether the defendants did anything wrong. The pending class action alleges that the Pfizer Defendants violated certain state antitrust and federal racketeering laws in the United States, harming competition and causing Class Members to overpay for EpiPen products. The Pfizer Defendants deny that they violated any laws and contend that their actions enhanced competition and did not cause Class Members to overpay.

Who is eligible for a refund?
If you are a person or entity in the United States who paid or provided reimbursement for some or all of the purchase price of Branded or authorized generic EpiPens for the purpose of consumption, and not resale, by yourself, your family member(s), insureds, plan participants, employees, or beneficiaries, at any time between August 24, 2011, and November 1, 2020, and didn’t exclude yourself, you are a class member.
Is a receipt required?
Proof of purchase is not required. However, if you have receipts, you may be able to claim more.

What is a class action lawsuit settlement?
For example, a class action lawsuit is one with multiple plaintiffs. In other words, there are more than one person being represented by the lawsuit. In other words, a plaintiff or plaintiffs file the case on behalf of many people who were affected by aren’t involved in the actual suit. For example, if you purchased an item that was later determined to be involved in a class action lawsuit, you may be entitled to compensation. If you’re included in the class or group of people affected, then you can file a claim to receive money, coupons or replacement products.
