Understanding the Eye Drops Settlement

Overview of the Lawsuit

The lawsuit is based on the allegation that eye drops were incorrectly labeled in order to mislead consumers.

The Named Plaintiffs allege that the Covered Products included in the Settlement were deceptively labeled and advertised as homeopathic when the Covered Products had not secured the appropriate approvals from the Federal Food and Drug Administration (“FDA”), were not manufactured according to Current Good Manufacturing Practices, were misleadingly marketed as “sterile,” and failed to disclose the risk of silver sulfate.

Similasan denies all of the Named Plaintiffs’ allegations and all charges of wrongdoing or liability against it arising out of any of the conduct, statements, acts or omissions alleged, or that could have been alleged against it, in the Action.

Eligible Consumers

This covers everyone in the U.S. and its territories who purchased, for personal use and not for resale, any Covered Product from September 11, 2017, until February 20, 2025.

How the Settlement Works

Eligibility: Only consumers who purchased covered products during the timeframe indicaed can file a valid claim.
Filing a Claim: Participants in the class can submit a claim to receive their share. Keep in mind the payout is distributed on a pro-rata basis, meaning how much each person gets depends on the total number of claims filed.
Deadline: All claims must be submitted by October 15, 2025, to ensure eligibility for any potential payout.

How do I file a claim?

They encourage eligible people to file online.

You will need to give them your name, address, email, and phone number.

How much will I get back?

Without Valid Proof of Purchase.

$2.50 for each Covered Product
maximum Cash Award of $10.00 per claim (i.e., each Household can claim a Cash Award for a maximum of 4 Covered Products).

Valid Proof of Purchase means verifiable documentation of a transaction that reflects the purchase of one or more Covered Products, on or before February 20, 2025.

Pro Rata Reduction/Increase

If the amount of payouts exceeds – or is less than – the amount of the settlement fund, then each award will be adjusted either more or less.

Charitable Cy Pres Contribution.

If any funds remain in the settlement fund following payment of all amounts due, then the remainder will be donated to The Public Justice Foundation. This includes uncashed checks after stop payments are implemented on them.

What’s the deadline to file a claim?

If you believe you are a Settlement Class Member and wish to receive a cash payment, you must submit a valid Claim Form. All Claim Forms must be submitted no later than October 15, 2025.

What is a class action lawsuit settlement?

For example, a class action lawsuit is one with multiple plaintiffs. In other words, more than one person is represented by the lawsuit. In other words, plaintiff(s) file the case on behalf of many people who were affected by but aren’t involved in the actual suit. For example, if you purchased an item that later was determined to be involved in a class action lawsuit, you may be entitled to compensation. If you’re included in the class (group) affected, you can file a claim to receive money, coupons, or replacement products.

But each case is different, and each will specify who is included. In addition, class action lawsuits may require proof that you are part of the group of affected people. In this case, proof of purchase, receipts, or other specified documentation is needed. However, in some cases, no proof is required. In that case, you can file a claim without proving that you are part of the class of people affected. Of course, when you file a claim you are doing so under penalty of perjury. So, do not file if you do not qualify.
